1. Agreement to Terms

By accessing or using TrafficPOS ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including merchants, staff, and administrators.

2. Description of Service

TrafficPOS is a cloud-based point of sale platform that provides inventory management, sales processing, reporting, online storefronts, and related business tools. The Service is provided on a subscription basis with free and paid tiers.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

4. Subscription and Billing

Free tier (TrafficStores) is available at no cost with no time limit.
Paid plans are billed monthly or annually. Prices are listed on our pricing page and may change with 30 days notice.
You authorize us to charge your payment method on file for recurring subscription fees.
Refunds are handled on a case-by-case basis. Contact support within 14 days of a charge for consideration.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws.
Attempt to gain unauthorized access to other accounts, systems, or networks.
Interfere with or disrupt the Service or its infrastructure.
Reverse engineer, decompile, or disassemble any part of the Service.
Resell or redistribute the Service without written permission.

6. Your Data

You retain ownership of all data you input into TrafficPOS, including products, sales records, and customer information. We do not sell your data. You may export your data at any time. Upon account termination, your data will be retained for 30 days before permanent deletion unless otherwise required by law.

7. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

8. Payment Processing

TrafficPOS integrates with third-party payment processors. Your use of payment processing features is subject to the terms and conditions of those processors. We are not responsible for payment processing errors, disputes, or chargebacks handled by third-party providers.

9. Intellectual Property

TrafficPOS and its original content, features, and functionality are owned by TrafficPOS and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive license to use the Service for its intended purpose.

10. Limitation of Liability

To the maximum extent permitted by law, TrafficPOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless TrafficPOS, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through the admin dashboard or by contacting support. We reserve the right to suspend or terminate accounts that violate these Terms, with notice where possible.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Saskatchewan, Canada. Any disputes shall be resolved in the courts of Saskatchewan.
